Picture It Settled® Predicts Outcome of Intellectual Property Case Within 3.5% in Just Two Rounds
Picture It Settled® announces today the release of an intellectual property case study written by Will Pryor, Mediator, Arbitrator and Adjunct Professor of SMU Law School in Dallas entitled, “Discovering Picture It Settled, Breakthrough Predictive Analytics Software for Negotiation.” Pryor shares how the highly-intelligent predictive analytics tool that guides inside and outside counsel through the negotiation process, based on deep data harvested from thousands of cases, predicted the outcome of his intellectual property case within 3.5% in just two rounds. That prediction then improved with additional offer data.

Also of interest to litigators is Picture it Settled, a Web-based application with a mobile app offering as well that uses predictive analytics including vast amounts of settlement data to assist lawyers during negotiations. Using this tool during negotiations, lawyers can, based on real-time input of offers and counter-offers, estimate when the opposing party will settle and for how much.

I previously reviewed Picture it Settled Lite, a free app by San Antonio mediator Don Philbin that can help you during mediations. Philbin has analyzed all of the data from the use of that app to come up with a computer program called Picture it Settled that can help predict when and where a case will settled based upon the empirical data. I haven’t tried it, but it sounds interesting.

Only a small number of law firms will still be forward thinking enough to offer forms of online dispute resolution in their practice areas. As complementary to their traditional services, rather than ODR, some firms may integrate the use of simpler online negotiation and settlement tools, such as the use of the app PictureItSettled, or online game-theoretic bargaining systems, such as those created by FairOutcomes.
